Court finds adversary’s actions are an “affront against fairness and . . . justice.”
Sanford Greenberg successfully concluded a lengthy litigation defending a member of a limited liability company in the business of purchasing non-performing mortgages. An intra-company dispute regarding the alleged misappropriation of approximately $50 milion led to seven related lawsuits in federal and state courts in New York and Florida as well as a criminal investigation. After nearly four years of intense litigation and a seven day trial in New York Supreme Court, the court dismissed all claims against our client. A key to the successful outcome was Sanford’s ability to establish that our client’s e-mail account had been hacked by his former partner and that privileged communications between Sanford and his client had been intercepted over a period of two months, conduct that the court described as an “affront against fairness and against the due administration of justice.” Click here to read the Special Referee’s Report.
